JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks the following relief:- “i) ISSUE a Writ of certiorari quashing the impugned communication at ANNEXURE-H dated 24.10.2024 bearing reference number HRW : IRS : (LEG) : HO LT 905 : PS 2024 made by the 3rd respondent. ii) ALLOW the Writ Petition and grant the full relief of Pension effective from the date of resignation i.e., accepted during the year 1990 till date together with interest and costs. iii) Pass any other appropriate order, direction or writ as this Hon’ble Court may deem fit to pass under the facts and circumstances of the case, to meet the ends of justice and equity.” 2. Heard learned counsel for the petitioner, learned CGSC for respondents No.1 and 2, learned counsel for respondent No.3 and perused the material on record. 3. In addition to reiterating the various contentions urged in the petition and referring to the material on record, learned - 4 - HC-KAR NC: 2026:KHC:23332 WP No. 30848 of 2025 counsel for the petitioner invited my attention to communication at Annexure-G dated 14.11.2024, in order to contend that in the light of the subsequent communication at Annexure-G dated 14.11.2024, the impugned communication rejecting the request of the petitioner deserves to be quashed and the respondent No.3 be directed to disburse/release the entire pension amount payable to the petitioner in terms of Annexure-G dated 14.11.2024 after deducting a sum of Rs.48,683.35/- as indicated in the said communication and also be directed to continue to pay the pension payable in favour of the petitioner in the future/subsequently as and when they fall due. 4. Per contra, learned counsel for respondent No.3 does not dispute that subsequent to impugned communication at Annexure-H dated 24.10.2024, Canara Bank Employees’ Pension Fund issued a communicated at Annexure-G dated 14.11.2024 admitting that petitioner would be entitled to receive pension, subject to debiting Rs.48,683.35/- with the respondent No.3-Bank and the petition may be disposed of issuing certain directions. - 5 - HC-KAR NC: 2026:KHC:23332 WP No. 30848 of 2025 5. In this regard, we request you to debit Rs.48683.35 (Rupees Forty Eight Thousand Six Hundred Eighty Three and Thirty Five Only) from the applicant's Account No.04152010114984 being the ex-employees Bank's Contribution of Provident Fund paid during the resignation and credit the same to Pension Fund collection Account No. - 6 - HC-KAR NC: 2026:KHC:23332 WP No. 30848 of 2025 0792111034230 on or before 28/11/2024 with narration “PORBC Staff ID Name”. (Example: If Staff ID is 12345 & Name is ABCD, Narration shall be PORBC_12345_ABCD) Please make sure that the account is debited only with the consent of the concerned ex-employee. Kindly make a note that pension will be paid from the month following which the Bank receives the Bank's Contribution of Provident Fund (along with accumulated interest thereon) as per DFS letter ef.No.4/8/2023-IR. As could be seen from the aforesaid communication, the respondent No.3 has categorically admitted that they would pay the pension payable to the petitioner subject to petitioner debiting Rs.48,683.35/- being the ex-employees banks contribution of provident fund during resignation and credit the same to the pension fund collection account. It is however a matter of record and an undisputed fact that the arrears of pension payable by the respondent No.3 to the petitioner is in excess of Rs.48,683.35/- as on today. Further, as directed by this Court in its order dated - 7 - HC-KAR NC: 2026:KHC:23332 WP No. 30848 of 2025 09.03.2026, the respondent No.3 has paid a sum of Rs.50,000/- to the petitioner during the pendency of the present petition. 7. Under these circumstances, I deem it just and proper to dispose of this petition directing the respondent No.3 to pay the arrears of pension payable to the petitioner after deducting the aforesaid some of Rs.48,683.35/- and Rs.50,000/- and settle the entire balance amount payable to the petitioner as on today within a period of four weeks in terms of Annexure-G dated 14.11.2024 within a period of four weeks from the date of receipt of a copy of this order. In addition thereto, the respondent No.3 shall continue to pay the pension payable to the petitioner as and when they fall due in terms of Annexure-G dated 14.11.2024. 8.
