The challenge in this application under Section 528 of BNSS is to the judgment and order dated 16.11.2019 passed by the Civil Judge (Jr. Division)/Judicial Magistrate, Haldwani, District Nainital in Criminal Case No.1526 of 2013, Jagdish Chandra Kandpal vs. Chandan Singh, under Section 138 of the Negotiable Instruments Act, 1881. 4. The respondent-Mr. Jagdish Chandra Kandpal appeared in person in Court and duly identified by his counsel Mr. Shariq Khushid, Advocate. 5. The compounding application has been filed on behalf of the parties, which is duly supported by the affidavit of the applicant and the respondent. On an interaction, Mr. Jagdish Chandra Kandpal the respondent herein has acknowledged the receipt of the cheque amount and he does not wish to pursue the matter any further. 6. In that view of the matter, the judgment and order dated 16.11.2019 is hereby quashed along with the entire proceedings of the criminal case. 7. The compounding application (IA No.2 of 2026) is allowed in the above terms. 8. Let the applicant be released forthwith, if he is not required in any other case. 9.
