ORDER The petitioner, who was arrested and remanded to judicial custody on 08.05.2026 for the alleged offences under Sections 376(3) of the Indian Penal Code (IPC) and Sections 5(1) and 6(1) of the POCSO Act, 2012, in Crime No.26 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner had committed aggravated penetrative sexual assault on the victim girl, which resulted in her https://www.mhc.tn.gov.in/judis

3. The learned counsel for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He would further submit that the petitioner has been in judicial custody since 08.05.2026 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for the grant of bail.
4. The learned Government Advocate (Crl.Side) appearing for the respondent, while opposing the grant of bail to the petitioner, reiterated the prosecution case and, on instructions, submitted that the statement of the victim under Section 183 of BNSS has been recorded.
5. I have given anxious consideration to the submissions made by the
learned counsel on either side.
6. On perusing the statement recorded under Section 183 of the BNSS, it is observed that there are serious allegations against the petitioner. Considering the fact that the petitioner's earlier application in Crl.O.P.No.17347 of 2026 was dismissed on 07.07.2026 and also upon the fact that there is no change in the circumstances, this Court is not inclined to enlarge the petitioner on bail. https://www.mhc.tn.gov.in/judis
