The case of the prosecution is that a motor accident claim petition in MCOP No.52 of 2019 had been filed before the MACT, Ulundurpet, seeking compensation for Rs.50,00,000/- for the death of Mr.P.Govindaraj, who died in a motor accident on 03.11.2018 involving a vehicle bearing registration No.TN32 F 0820. An insurance proposal form, instead of valid insurance policy was filed for the said claim. Subsequently, the Insurance company stated that the document provided was not a policy copy and it is only a proposal form and the vehicle was not insured with the respondent. Hence, the Insurance company has lodged a complaint in order to identify the accused involved. 3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in the present case and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner. 4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that the petitioner has no criminal antecedents. However, opposed the grant of anticipatory bail to the petitioner. 5. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); considering the totality of the circumstances and upon the nature of allegation, this Court is of the firm view that it is not appropriate to consider the anticipatory bail application at this stage. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. 7. Accordingly, this Criminal Original Petition stands dismissed. 13-08-2026 SHL To: 1.
