Petitioner is serving as Tax and Revenue Inspector in Palika Centralised Services. In this writ petition, she has challenged order of transfer dated 17.01.2026, whereby she was transferred from Nagar Nigam Rudrapur to Nagar Nigam, Almora. She has also sought a mandamus directing the competent authority to consider her claim for promotion to the next higher post of Tax Superintendent. 5. Since petitioner has joined duties at the transferred place i.e. Almora, though under protest, therefore, this Court is not inclined to interfere with the transfer order. 6. Learned counsel for the petitioner submits that persons junior to the petitioner in the cadre of Tax Inspector, have been promoted as Tax Superintendent, however, petitioner’s claim is not being considered so far, even though vacancies are still available. 2026:UHC:4305 7. Learned State Counsel, however, submits that there are certain adverse remarks in the service record of the petitioner, which would be the reason for her non-promotion. 8. Without expressing any opinion on the rival contentions raised by learned counsel for the parties, the writ petition is disposed of with a direction to Director, Urban Development, Uttarakhand to determine vacancies available on the post of Tax Superintendant. If two or more vacancies are available on that post, then he shall initiate promotion exercise and consider claim of petitioner for such promotion, if she is found eligible. Needful be done within six months from the date of presentation of certified copy of this order. 9. Learned counsel for the petitioner submits that her salary for about three months as well as the amount of medical reimbursement has not been released so far. If that is so, petitioner shall be at liberty to make representation; and representation, if made within ten days, shall be decided by Director concerned, within three months.
