Date : 15.05.2026. Heard Mr. M. Mondal, learned counsel for the petitioners. Also heard Mr. D.P. Goswami, learned Addl. P.P., Assam appearing on behalf of the State

This is an application under Section 482 of BNSS, 2023 praying for grant of pre- arrest bail to the accused/petitioners, namely, Bappi Sk and Bablu Sk @ Bodior Rahman, who are apprehending arrest in connection with the Dhubri P.S. Case No. 99/2026, registered under Sections 61(2)/87/127(3)/3(5) of the BNS, 2023. The case diary is received and perused the same. It is submitted by Mr. Mondal, the learned counsel that the present accused petitioners are innocent and have not committed any offence as alleged in the FIR. However, the girl has been recovered and her statement is also recorded. Mr. Mondal further submitted that the petitioners are still ready and willing to extend their further cooperation in investigation of the case, if they are granted with the privilege of pre-arrest bail. Mr. Goswami, the learned Addl. P.P., Assam submitted in this regard that it is a fact that the victim girl has already been recovered and her statement has also been recorded. Considering the submissions made by learned counsel for both sides and the materials in the case diary, specially the statement made by the victim under Section 108/183 of the BNSS, 2023 and the fact that the accused petitioners have already extended their cooperation, I find that custodial interrogation of the accused petitioners may not be required for the purpose of investigation. Accordingly, it is provided that in the event of arrest of the accused/petitioners, namely, Bappi Sk and Bablu Sk @ Bodior Rahman in connection with the Dhubri
Page No.# 3/3 P.S. Case No. 99/2026, they will be enlarged on pre-arrest bail on executing a bond of Rs.
20,000/- (Rupees twenty thousands) only, with one surety of like amount for each of them, to the satisfaction of the arresting authority, subject to the following conditions:- (i) that the petitioners will make themselves available for interrogation by the Investigating Officer within 7 (seven) days; (ii) that the petitioners will fully co-operate with the investigation of the case and will appear before the Investigating Officer as and when required in connection with the investigation of the aforesaid P.S. case; and (iii) that the petitioners will not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her/them from disclosing such facts to the Court or to any police officer.
