Since no adverse order is going to be passed against the private respondents, notice to them is dispensed with. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3.According to the petitioner, the subject property originally belonged to one Mariya Selvin. He executed a 'WILL' dated 23.06.2021 in favour of the petitioner bequeathing the subject property to the petitioner. On the strength of the said 'WILL', the petitioner filed an application before the official respondent seeking transfer of patta. It is also seen from the typed set of papers that wife and daughter of Mariya Selvin filed a suit in O.S.No.57 of 2025 on the file of the Subordinate Court, Tiruchendur, seeking declaration of title and permanent injunction against the petitioner and other persons. The petitioner filed a written statement resisting the suit based on the 'WILL' executed by Mariya Selvin. Therefore, the validity of the 'WILL' relied on by the petitioner is very much under dispute in the civil suit. In such circumstances, this Court is not inclined to issue any positive direction to the respondent to consider the representation of the 2/4 https://www.mhc.tn.gov.in/judis W.P(MD)No.23396 of 2026 petitioner seeking issuance of patta pending disposal of the suit. Hence, the Writ Petition stands dismissed. However, it is clarified that after disposal of the suit, on the strength of the decree passed in the civil suit, parties are at liberty to approach the revenue authorities seeking issuance of patta.
