No.22737 of 2026 PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 3 to inspect the Government Poramboke land comprised in S.No.534/14, situated at Silaneerpatti Village, S.V.Mangalam, Singampunari Taluk, Sivagangai District, to verify the revenue records and conduct a survey through the jurisdictional Survey Department, if necessary, to remove the illegally placed boundary stones, fencing posts, barbed wire, fencing materials, and any other encroaching structures put up by private individuals in the Government Poramboke land by invoking the provisions of the Tamil Nadu Land Encroachment Act, 1905, and other applicable laws to initiate appropriate proceedings against the persons responsible for the illegal encroachment upon Government land and to ensure that no person unlawfully interferes with the petitioner's peaceful possession and enjoyment of his patta land comprised in S.No.534/13C or obstruct the petitioner's lawful construction activities. The writ petition has been filed in the nature of a Mandamus, seeking a direction to the respondents 1 to 3 to conduct survey in the Government Poramboke land comprised in S.No.534/14 at Silaneerpatti Village, S.V.Mangalam, Singampunari Taluk, Sivagangai District. 2.However, it is the contention of the respondents that the petitioner is an encroacher of the said land in S.No.534/14 and that a notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905, had been issued to the petitioner herein. It is contended that he had suppressed these facts and had contended that there is an encroachment in the said land. He had not impleaded any private party in the writ petition. If the petitioner is found to have encroached into the Government land in S.No.534/14, then he must be vacated. 3.The learned counsel for the petitioner contends that a proper 3/6 https://www.mhc.tn.gov.in/judis WP(MD). No.22737 of 2026 survey may be conducted and thereafter, further proceedings may be initiated. 4.In view of the above, let survey be conducted to ascertain whether there is any encroachment in S.No.534/14. If it is found that the petitioner or anybody else has encroached into the said land, the respondents are at liberty to proceed further in the manner known to law. If it is found that the petitioner has encroached into the said land, then further proceedings pursuant to the notice issued under Section 7 of the Tamil Nadu Land Encroachment Act, 1905, may be initiated by the respondents. The petitioner may co-operate during the conduct of the survey. 5.Accordingly, the writ petition stands disposed of with the above directions. No costs.
