The petitioner is apprehending his arrest in connection with Sursang PS Case No.18 of 2025, for offence registered under sections 303(2) and 317(5) of BNS, 2023, sections 4 and 21 of Mines and Minerals (Development and Regulation) Act, 1957, Rules 4 and 54 of Jharkhand Minor Mineral Concession Rules, and Rules 7 and 9 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, pending in court of learned Judicial Magistrate First Class, Gumla. 3. Learned counsel for the petitioner submits that the petitioner is the owner of the tractor in question and the allegations are made that 100 cft sand was loaded on the said tractor. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.11 of the petition. 4. Learned State counsel opposes prayer and submits that illegally the said sand was being carried on the said tractor. 5. Considering that the petitioner is the owner and he is having no criminal antecedent as aforesaid, and in that view of the matter, the petitioner, above named, is, hereby, directed to surrender before learned court within two weeks from today, and learned court shall release the petitioner, above named, on such terms and conditions as well as sureties as the learned court may deem fit and proper. 6.
