Sundar, CJ) 21.07.2026 [1] Mr. Anjan Prasad Sahu, learned counsel on record for MCs (Miscellaneous Cases) applicants in captioned MC(WA)No.41 of 2026 and MC(WA)No.42 of 2026 is before this Court (physical Court). [2] Captioned afore-referred MCs have been filed with Condonation of Delay (CoD) prayers. [3] When the captioned matters were taken up, it came to light that inter-alia the dates of filing of the writ appeals have been given erroneously and consequent error in computation of length of delay has crept in qua captioned MCs. [4] Faced with the above situation, Mr. Anjan Prasad Sahu, learned counsel on record for MCs applicants sought leave of this Court to withdraw captioned MCs but made a plea to preserve all the rights and contentions of MCs applicants to file CoD applications afresh after making requisite course correction/s and he also sought preservation of rights and contentions of MCs applicants to do so. Leave with liberty/preservation of rights as sought for is granted. [5] Learned counsel on record for MCs applicants has made endorsements in the case files qua withdrawal and a scanned reproduction of the same are as follows: MC(WA)No.41 of 2026 MC(WA)No.42 of 2026 [6] In the light of the narrative thus far, captioned MCs are disposed of as withdrawn/closed albeit with preservation of rights and contentions of MCs applicants and liberty to file CoD MCs again (obviously after making course corrections) in the aforesaid manner.
