For Bail in Crime No. 189 of 2026 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioners/A1 to A3, who were arrested and remanded to judicial custody on 15.07.2026 for the offences punishable under Sections 109, 126(2), 296(b), 49 and 61(1) of BNS, 2023, in Crime No. 189 of 2026, on the file of the respondent police, seek bail. 2.The case of the prosecution is that on 10.07.2026, after completing work, when the defacto complainant was returning to his house on his two wheeler, the accused intercepted the defacto complainant and abused him in filthy language. When the same was questioned by the defacto complainant, the accused assaulted him with sword. Hence, the complaint. 3.The learned counsel appearing for the petitioners would submit 2/6 CRL OP(MD). No.18136 of 2026 that the petitioners are innocent and they have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. He would further submit that the injured has been discharged from the hospital. The petitioners are in judicial custody from 15.07.2026. Hence, he prayed to grant bail to the petitioners. 4.The learned Counsel for State of Tamil Nadu (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioners have no previous cases to their credit. Though the injured person has already been discharged from the hospital, considering the grave nature of offence, he strongly opposed to grant bail to the petitioners. 5.Considering the above facts and circumstances, nature of offence levelled against the petitioners and also the facts that the petitioners are in judicial custody from 15.07.2026; that the petitioners are not having any bad antecedents and that the injured was discharged from the hospital, this Court is inclined to grant bail to the petitioners subject to the following conditions: 3/6 CRL OP(MD). No.18136 of 2026 6.Accordingly, this Criminal Original Petition is allowed and the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Kariyapatti, Virudhunagar District, and on further condition that; (i)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; (ii)the petitioners shall report before respondent Police daily at 10.30 a.m., for a period of third days and thereafter as and when required for interrogation; (iii)the petitioners shall not tamper with evidence or witness; (iv)the petitioners shall not abscond during trial; (v)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by 4/6 CRL OP(MD).
