W.P(MD)No.23402 of 2026 ORDER The writ petition is filed seeking a direction to the respondents to rectify the mistake in Field Measurement Book pertaining to S.F.Nos.255/28 and 255/32. 2.Heard Mr.B.Sekar, learned counsel, appearing for the petitioner and Mr.C.Deepak, learned Additional Government Pleader, who takes notice for the respondents 1 to 5. Since no adverse order is going to be passed against the sixth respondent, notice to him is dispensed with. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3.According to the petitioner, the property in S.Nos.255/32 and 255/28 were purchased by the petitioner's father in the year 1970 and 1962 respectively and after his demise, the petitioner and his brother have been in possession and enjoyment of the subject property. It is further stated that the sixth respondent, with the assistance of revenue officials, obtained an erroneous entry in FMB as if there is a line exists in the above mentioned survey numbers. The petitioner submitted a representation before the official respondents seeking correction of FMB. However, the same has not been considered. W.P(MD)No.23402 of 2026 4.The learned Additional Government Pleader, who takes notice for the respondents 1 to 5, submits that the representation of the petitioner will be considered by the third respondent in accordance with law. He further submits that, in case, any correction is required, the same can be done only by the Assistant Director of Survey and Land Records. However, he has not been made as party to the present writ petition.
5.In view of the submission made by the learned Additional Government Pleader, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the representation of the petitioner dated 24.07.2026 and pass final orders, on its own merits, within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, sixth respondent, neighbouring land owner and other interested parties, if any. In case, the third respondent comes to a conclusion that any correction in FMB is required, he shall forward his report to the Assistant Director of Survey and Land Records, Sivagangai, and the same shall be considered by him in accordance with law, within a further period of four weeks. 3/5 https://www.mhc.tn.gov.in/judis
