CIVIL MISC.PETITION NO: 141 OF 2026 ORDERS: 1. Petitioners herein are the respondents in F.C.O.P.No.1840 of 2025. They filed the present application seeking withdrawal and transfer of the said F.C.O.P from the file of learned V Additional District and Sessions Judge –cum- Family Court, Visakhapatnam to the court of learned IV Additional District & Sessions Judge –cum- Principal Family Court, Vijayawada. 2. The case in F.C.O.P.No.1840 of 2025 is filed with a prayer for recovery of Rs.91,35,498/- said to be the marriage expenses etc.,. The 1st petitioner is the wife, respondent is her husband. The petitioners have filed for transfer of the case from the learned court of V Additional District and Sessions Judge –cum- Family Court, Visakhapatnam to the court of learned IV Additional District & Sessions Judge –cum- Principal Family Court, Vijayawada on the ground of financial difficulties etc.,. 3. Learned Counsel for respondent fairly submitted that there are no grounds and orders may be passed on merits. 4. Upon considering the facts and circumstances and the residence of the wife at Vijayawada and also the nature of the suit being filed for damages, including marriage expenses said to have been incurred, during the subsistence 4 AHHS,J Tr.C.M.P.No. 141 of 2026 of the marriage etc., the prayer for transfer is found convincing and petition is allowed, as follows: i. The F.C.O.P.No.1840 of 2025 is withdrawn from the file of V Additional District and Sessions Judge –cum- Family Court, Visakhapatnam, and transferred to the court of learned IV Additional District & Sessions Judge – cum- Principal Family Court, Vijayawada, for disposal according to Law. ii. Learned Judge, V Additional District and Sessions Judge –cum- Family Court, Visakhapatnam, is directed to transmit the case record forth-with, after duly indexed. iii. Learned IV Additional District & Sessions Judge –cum- Principal Family Court, Vijayawada, is directed to dispose of the case as early as possible. iv. Both the parties are directed to cooperate for speedy disposal of the case, without taking any unnecessary adjournments. 5. Accordingly, the Transfer, Civil Miscellaneous Petition is allowed.
