No.22448 of 2026 ORDER Heard the learned counsel for the petitioner, Mr.C.Jeganathan, learned Special Government Pleader appearing for the respondents 1 and 2 and Mr.Mohammed Imran, for M/s Ajmal Associates appearing for the third respondent. 2. The petitioner herein, who was appointed as the Secondary Grade Teacher in the third respondent school in the year 1990, was subjected to disciplinary proceedings by the third respondent in the year 2025 and accordingly, a punishment of compulsory retirement was imposed on the petitioner vide proceedings in f.bjh.No.171 dated 14.08.2025. It is aggrieved by the same, the petitioner approached this Court by filing WP(MD)No.24126 of 2025. Vide order dated 10.12.2025, the matter was remanded back to the third respondent for providing an opportunity to the petitioner and to pass orders. Again the third respondent passed order vide the proceedings dated 20.05.2026 imposing 2/6 WP(MD). No.22448 of 2026 the very same punishment of compulsory retirement from service. Aggrieved thereby, the petitioner claims to have filed an appeal under Section 41 of the Tamil Nadu Private Schools (Regulation) Act, 2019, through the second respondent on 05.06.2026 and the same was forwarded by the second respondent to the first respondent. But the same is still pending for consideration before the first respondent. Hence, the petitioner has approached this Court seeking appropriate direction to the first respondent to dispose of the said appeal. 3. Mr.C.Jeganathan, learned Special Government Pleader appearing for the respondents 1 and 2 brought to the notice of this Court that the petitioner herein instead of filing an appeal before the first respondent has erroneously filed before the second respondent. However, the same was forwarded by the second respondent to the first respondent now and hence there is some delay in forwarding the appeal before the first respondent. 4. Mr.Mohammed Imran, learned counsel appearing for M/s Ajmal Associates for the third respondent fairly submitted that he has no 3/6 WP(MD). No.22448 of 2026 objection for consideration of the appeal filed by the petitioner on merits by the first respondent without reference to the delay in filing the said appeal. 5. In the light of the above, without going into merits of the matter, this writ petition is disposed of directing the first respondent to consider the appeal dated 05.06.2026 and further representation submitted by the petitioner dated 25.07.2026 against the proceedings dated 20.05.2026. passed by the third respondent as expeditiously as possible at any rate within a period of two months from the date of receipt of a copy of this order.
