2. The petitioner is working on the post of Workman/Work Supervisor with respondent nos. 4 and 5. An order dated 26.12.2025 was issued by respondent no. 5, whereby the services of the petitioner were transferred from the Pantnagar Unit to the Hosur Unit, Tamil Nadu. Aggrieved by the said transfer
order, the petitioner preferred an application before the Deputy Labour Commissioner, Rudrapur, District Udham Singh Nagar. Upon the said application, the Deputy Labour Commissioner fixed 02.01.2026 for enquiry. On the said date, respondent nos. 4 and 5 failed to appear. Thereafter, the next date was fixed as 05.01.2026; however, even on the said date, respondent nos. 4 and 5 remained absent. Learned counsel for the petitioner submits that thereafter no further date has been fixed in the matter.

Learned counsel appearing for respondent nos. 2 and 3 raised a preliminary objection regarding the maintainability of the present writ petition against a private company.
4. Since the petitioner has already
2026:UHC:631 approached the competent authority by filing an application challenging his transfer and the same is stated to be pending consideration, learned counsel for the parties jointly submit that the present writ petition may be disposed of with a direction to the Deputy Labour Commissioner to decide the petitioner’s pending application within a period of fifteen days. It is further agreed that till the disposal of the said application, the petitioner may be permitted to continue at his present place of posting.
5. Accordingly, the writ petition is
disposed of with a direction to the Deputy Labour Commissioner, Rudrapur, District Udham Singh Nagar, to decide the pending application of the petitioner within a period of 15 days, in accordance with law. Till such time, the petitioner shall be permitted to continue at his present place of posting.
6. It is clarified that this Court has not expressed any opinion on the question of maintainability of the writ petition.
