This is an application filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS) 2023 praying for grant of pre-arrest bail to the accused applicant in connection with Abhayapuri P.S. Case No.265/2025, registered under Sections 331(4)/305(a) of BNS, 2023. The case relates to the lodging of an FIR dated 29.11.2024 alleging that Page No.# 2/2 some miscreants entered the house of the informant and, after spraying a certain substance on the faces of three family members, broke open the almirah and left after stealing gold ornaments along with cash amounting to Rs. 24,000/-. An earlier bail petition was rejected on 16.03.2026 passed in A.B No. 394 of 2026. Upon calling for the Case Diary, it has been informed to the learned Additional P.P vide Wireless Communication dated 11.05.2026 that in the meantime investigation stood completed and the same has resulted in a charge- sheet against 9 accused persons including Md. Sahidul Sheikh son of Sahed Ali Sheikh. Ms. B. Gogoi, learned counsel for the petitioner submits that as per her instructions the present petitioner is having the same name as the charge- sheeted person mentioned above and that due to this confusion he is having apprehension of arrest. It is further submitted that in view of completion of investigation, the petitioner is willing to appear before the learned Court below. Also heard the learned Additional P.P appearing for the State. In the circumstances and the subsequent development by way of completion of investigation-this bail petition is disposed of with the observation that -the petitioner shall appear before the learned Court below and pray for a regular bail and necessary orders shall be passed therein, also keeping in mind the aspect of completion of investigation Anticipatory bail petition stands disposed of.
