In the affidavit filed in support of this petition, it is stated that the petitioner is a senior citizen suffering from age related ailments which prevented him from giving necessary instructions to the counsel. Hence, there has been a delay. 3. Notice had been directed and notice was served. The learned counsel entered appearance for the respondents. 4. Taking the above stated facts into consideration, the delay stands condoned and this petition is allowed. The Registry is directed to number the appeal if it is otherwise in order.
