The Court made the following Order:-
The present Writ Petition is filed aggrieved by the proceedings dated 08.05.2026, whereby the 2nd respondent has branded the petitioners as encroachers and directed them to vacate the premises in the event of their failure to submit an explanation along with documents establishing their entitlement over the subject property. 2. Heard learned counsel for the petitioners and learned Standing Counsel for the respondent Municipality. 3.
Learned counsel for the petitioners submits that, in W.P. No.13345 of 2025, this Court directed the respondents to consider the documents submitted by the petitioners and pass appropriate orders. It is submitted that, pursuant thereto, the petitioners submitted the required documents under representation dated 22.05.2026. However, without considering the said representation, the 2nd respondent issued the proceedings dated 08.05.2026 and is attempting to dispossess the petitioners by sending men to the subject property.

Learned Standing Counsel appearing for the 2nd respondent submits that the petitioners have failed to submit the requisite documents and that the Tahsildar, Hindupuram, has endorsed that no pattadar passbooks or title deeds have been issued in favour of anyone in respect of Survey No.259/1 of Kotnuru Village.

Learned counsel for the petitioners, however, submits that the petitioners are in lawful possession of the subject property by virtue of the patta certificates granted in their favour.

In view of the aforesaid submissions, the Writ Petition is disposed of by directing respondent No.2 to consider the representation of the petitioners, duly taking into consideration the patta certificates issued in favour of each of the petitioners, and thereafter pass appropriate orders. It is also made clear that the petitioners shall furnish copies of their title documents to respondent No.2 to enable verification and passing of appropriate orders. Till such exercise is completed, the possession and enjoyment of the petitioners shall not be disturbed. Needless to mention, the entire exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this
order. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed
