This writ petition has been filed under Article 226 of the Constitution of India, claiming the following relief: “writ of mandamus declaring the action of the proceeding 4th respondent vide Lr No.DEE/400kV/Const/RJY/ F.No.PLVM/ D.No.249/24,Dt.22.03.2024 in issuing without considering my representation dated 11-03-2024 to grant compensation as per the conversion proceedings vide No.D.Ds /2023/3 D, dated 24-03-2023. from agriculture land to non-agriculture land and fixing and granting compensation for petitioners' land as agriculture land in S.y.No.408-1B an extent of Ac.1.66 cents and S.y.No. 408-1C to an extent Ac. 0.15 cents total extent of Acl.81 cents Polavaram village and Mandal, Jangareddygudem Revenue Division, is illegal, arbitrary and in violation of Art. 14, 19 and 300-A of the Constitution of India, consequently direct the respondents to fix the compensation and solatium charges to the petitioner's land in S.y.No.408-lB an extent of Ac.1.66 cents and S.y.no. 408-1C to an extent Ac. 0.15 cents total extent of Ac.l.81 cents Polavaram village and Mandal, Jangareddy gudem Revenue Division, West Godavari District, by taking in to consideration vide the conversion proceedings No.D.Ds /2023/3 D, dated 24-03-2023” 2. The case of the petitioner herein is that, Respondent No. 4 issued proceedings dated 22.03.2024 under which the compensation was determined regarding the petitioner's land, which was affected by the 400 KV Quad Moose Double Circuit Transmission Line of the Polavaram Jala Vidyuth Kendram. The petitioner contends that the compensation was determined without considering the representation NV,J W.P.No.8112 of 2024 4 dated 11.03.2024 and without taking into account that the land had already been converted from agricultural to non-agricultural use through proceedings dated 24.03.2023. Therefore, the compensation shall be determined after having considered the objections and other material placed before the authority concerned. Hence the writ petition. 3. The learned Standing Counsel for the respondents submitted that the compensation was determined after considering all relevant factors, in accordance with the guidelines only by the District Collector, who is the competent authority, under G.O.Ms. No. 357 dated 23.03.2006. It was further submitted that if the petitioner is dissatisfied with the compensation as awarded, the petitioner has an effective statutory remedy under Section 10 of the Indian Telegraph Act, 1885, by approaching the jurisdictional District Judge for enhancement of compensation, including for consideration of the land conversion proceedings and other issues also would be raised before the Appellate Court. Learned counsel for the petitioner agreed to approach the concerned Court for appropriate relief. 4. After considering the submissions of both sides and perusing the material on record, this Court deems it appropriate to direct the petitioner to approach the District Judge under Section 10 of the Indian Telegraph Act for enhancement of compensation and for consideration NV,J W.P.No.8112 of 2024 5 of all objections, including those relating to the conversion of the land. The petitioner shall file the appropriate application within four weeks from the date of receipt of a copy of this order. On such application being filed, the learned District Judge shall consider the matter and pass appropriate orders in accordance with law. 5. With the above directions, the writ petition is disposed of. There shall be no order as to costs. 6.
