Pleader for R1 1/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.22964 of 2026 ORDER The writ petition is filed seeking a direction to the first respondent to dispose of the proceedings pending on his file in Na.Ka.A1/3482/2025 in the light of the judgment passed by this Court in WP(MD).No.5076 of 2024 dated 10.02.2026. 2.Heard the arguments of Mr.RM.Arun Swaminathan, learned counsel for the petitioner and Mrs.Porkodi Karnan, learned Special Government Pleader appearing for the first respondent. Since no adverse order is going to be passed against the second respondent, notice to the second respondent is dispensed with. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3.It is seen from the typed set of papers that the second respondent had filed an application before the Revenue Court, Madurai, in T.C.T.P. No.7 of 2022, seeking recognition as a cultivating tenant in respect of the property situated in Survey No.743 in Watrap Village, Virudhunagar District. The said application was disposed of by the Revenue Court, directing the second respondent to file an appropriate application before the Tahsildar. It now appears that the second respondent filed an application before the Tahsildar seeking recognition of his name as a cultivating tenant in respect of the said property and the same is pending in proceedings Na.Ka.A1/3482/2025. 2/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.22964 of 2026 4.Under the provisions of the Tamil Nadu Agricultural Lands Record of Tenancy Rights Act, the competent authority to consider an application for recording a person as a cultivating tenant in respect of a land is the Record Officer/Tahsildar. Therefore, the Revenue Court rightly relegated the second respondent to approach the competent authority, namely, the first respondent. The said proceedings are also stated to be pending on the file of the first respondent. 5.In the light of the above, the first respondent is directed to consider the application submitted by the second respondent in accordance with the provisions of the relevant enactment and pass final orders on its own merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and the second respondent and affording due opportunity of hearing to both parties. 6.With the above directions, this writ petition stands disposed of.
