For Petitioner : Mr.L.Prabhu For Respondents : Mr.V.Shathurthi Raja Government Advocate (Crl.Side) for R1 1/4 https://www.mhc.tn.gov.in/judis Crl.OP(MD) No.17920 of 2026 ORDER The present petition has been filed by A2 in CC No.133 of 2023 on the file of learned District Munsif cum Judicial Magistrate Court, Vilathikulam, Thoothukudi District, seeking to quash the charge sheet, wherein, the petitioner is charged with the offence under Sections 294(b), 324, 341, 506(2) and 120(B) of IPC. 2.Perusal of the charge sheet reveals that the petitioner herein, who is the wife of the defacto complainant, is said to have developed an extra marital relationship with A1. Thereafter, A1 and A2 are said to have instigated the other accused persons to commit murder of the defacto complainant. The 161(3) of Cr.P.C., statement of the defacto complainant reveals specific overt act as against the petitioner herein. 3.According to the learned counsel appearing for the petitioner, the petitioner is not having any other relationship and she continues to live with her husband. A false case has been foisted against her. He further submits that the name of the petitioner is found not in the FIR. 2/4 https://www.mhc.tn.gov.in/judis Crl.OP(MD) No.17920 of 2026 4.Heard learned counsel appearing for the petitioner and perused the materials available on record. 5.As could be seen from the charge sheet, specific overt acts are alleged as against the petitioner herein. The statement recorded under section 161(3) of Cr.P.C., of the defacto complainant (husband of the petitioner) also reveals the role played by the petitioner herein. 6.In such circumstances, this Court does not find any reason to entertain the present petition. Accordingly, this Criminal Original Petition stands dismissed.
