ORDER (Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) Challenging the order dated 24.07.2026 passed by the 1st respondent granting 3 days emergency leave to the petitioner with escort, the petitioner has filed this writ petition to allow her brother to go on leave without escort.
2. The learned counsel for the petitioner submitted that the petitioner belongs to a poor family. It was further submitted that the leave has been sought solely for the purpose of attending to the petitioner's ailing mother. Therefore, the petitioner will be burdened with escort expenses if her brother/convict prisoner is allowed to go on leave with escorts. Hence, the learned counsel would pray that the convict prisoner may be permitted to go on leave without escort.
3. The learned Counsel for the State of Tamilnadu would submit that the emergency leave is granted for 15 days per year at the spell of 3+3+3+6. In this case, on the previous occasion, the petitioner was granted only 3 days leave and now also granted 3 days leave with escorts. https://www.mhc.tn.gov.in/judis
W.P.Crl(MD) No.4470 of 2026 4.The learned counsel for the petitioner would submit that since the convict prisoner is going to attend his ailing mother, the leave may be extended to six days.
5. Taking into consideration the above submission of the learned counsel for the petitioner, we are inclined to modify the condition to the effect that the convict prisoner will be allowed to go on emergency leave for six days, but without escort. The other conditions imposed in the impugned order dated 24.07.2026 shall stand as it is.
6. This Writ Petition (Criminal) is disposed of in the above terms.
