This writ petition has been filed by petitioner for a direction to respondent No.1 to forward her application No.2025020346 along with the necessary formalities to respondent No.2 within a time bound manner.

It is contended by
learned counsel for petitioner that the petitioner is a person with Tibetan Origin born to Tibetan refugees. Petitioner was born on 05.08.1990 in Dekyiling Tibetan Colony, Kulhan, P.O. Kulhan, Sahastradhara Road, Dehradun, Uttarakhand, India. Petitioner received all her education in Dehradun. Petitioner thereafter married to Mr. Tenzin Losel-an Indian citizen, in the year 2022. Passport of petitioner’s husband is also annexed as Annexure No.4 to the writ petition.

It is further contended by him that petitioner moved an application under Section 5(1)(c) of the Citizenship Act, 1955, for citizenship by registration to the District Magistrate, Dehradun on 03.08.2025, which was registered as application No.2025020346. But the
2026:UHC:4342 2 said application is still pending with District Magistrate Dehradun.

Attention of this court has been drawn by
learned counsel for petitioner to Rule 12 of the Citizenship Rules 2009, which enjoins the Collector to forward such application along with a report to State Government within 60 days from the date of its receipt.

The averment has been made by petitioner that District Magistrate/Collector, Dehradun has not forwarded the said application to State Government as required under Rule 12 of the Citizenship Rules 2009 and the same is still pending with District Magistrate/Collector, Dehradun.

An innocuous prayer has been made by
learned counsel for petitioner before this Court that the District Magistrate/Collector, Dehradun is directed to forward the application No.2025020346 moved by petitioner within stipulated period to State Government after completing the requisite formalities as per Rule 12 of the Citizenship Rules 2009.

To this prayer, there is no opposition from the side of respondents.

Accordingly, the present writ petition is
disposed of. District Magistrate/Collector, Dehradun is
directed to forward the application No.2025020346 moved by petitioner under Section 5(1)(c) of the Citizenship Act, 1955, to the State Government within 30 days from today strictly in accordance with law along with all the necessary formalities and report.
