For Petitioner : Mr.N.Pragalathan For R1 to R5 : Mr.S.Venkatesh Additional Government Pleader ORDER There is no merit in the present writ petition for a Mandamus, directing the respondents 1 to 4 to reclassify the petitioner's land situated in Survey No. 629/1A, Kullappapuram Village, Periyakulam Taluk, Theni District measuring to an extent of 1 Acre 61 cents as ''Punja Manavaari Land''. 2. On a specific query as to whether the petitioner was carrying on any agricultural activity, the learned counsel for the petitioner would submit that indeed the petitioner is carrying on agricultural activity. However, there are no records to substantiate that the petitioner is indeed carrying on agricultural activity. The land has been reclassified and the value has been determined in accordance with Section 47-AA of the Indian Page No.2 of 5 https://www.mhc.tn.gov.in/judis WP(MD)No.22572 of 2026 Stamp Act, 1899. The argument of the petitioner that there are neighboring lands which have been still continued to be classified as Punja Manavari, is of no concern of the petitioner. However, it is for the respondents to reclassify those lands as well in case, the lands in the neighboring area are also presently being classified as Punja Manavari, as there can be no discrimination. In case, the petitioner wants to dispose the land, the buyer may purchase the land. In case there is any dispute regarding the stamp value, reference can be made under Section 47A of the Indian Stamp Act. 3. With the above observations, the Writ Petition is disposed of.
