No.16548 of 2026 ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 18.07.2026 for the offences punishable under Sections 329(3), 296(b), 121(1) and 351(3) of BNS, 2023, and Section 3 of Tamil Nadu Medicare Service Persons and Medicare Service Institutions (Prevention of Violence and Damage of Loss Property) Act, 2008, in Crime No.0244 of 2026, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 16.07.2026, at about 09.45 p.m., the petitioner herein along with three others came by an auto to the Kannanoor primary Health Centre for taking treatment for snake bite to Chandran. At that time, one nurse namely, Sunitha and one Sweeper were on duty and they informed the accused persons that treatment for snake bite medicine was not available at the said Primary Health Centre and advised that the patient be taken to Government Hospital, Thuckalay for treatment. Subsequently, 108 ambulance was arrived and during the course of the incident, there was an altercation and the accused persons assaulted the ambulance driver and another and damaged the 108 ambulance. No.16548 of 2026 arrested. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is in judicial custody from 18.07.2026. Therefore, prayed to grant bail to the petitioner. 4.The learned Counsel for State of Tamil Nadu (Crl.Side) appearing for the respondent police reiterated the prosecution and submitted that the respondent is having evidence to show that the first accused damaged the ambulance. He would further submit that the investigation in this case is still pending and that the offences are grave in nature. He would further submit that the petitioner is involved in two previous cases registered under Section 323 of BNS, 2023. Hence, he strongly opposed to grant bail to the petitioner. 5.Considering the above facts and circumstances, nature of offence levelled against the petitioner and also the facts that the petitioner is in 3/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.16548 of 2026 judicial custody from 18.07.2026, that the date of occurrence is alleged to have been taken place on 16.07.2026, by this time the most of the investigation might have been completed and that the petitioner is not having any previous case for serious offence, this Court is inclined to grant bail to the petitioner subject to the following conditions: 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Padmanadapuram, and on further conditions that; (i)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; (ii)the petitioner shall report before the respondent Police daily at 10.30 a.m., for a period of 30 days and thereafter as and when required for interrogation; (iii)the petitioner shall not tamper with evidence or witness; 4/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.16548 of 2026 (iv)the petitioner shall not abscond during trial; (v)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; (vi)If the accused thereafter abscond, a fresh FIR can be registered under Section 269 BNS, 2023.
