PRAYER :- For Bail in connection with the case in S.C.No.212 of 2026 before the Principal Sessions Court, Thanjavur, in Crime No.5 of 2024 on the file of the Respondent Police. 1/6 CRL OP(MD). No.16767 of 2026 ORDER : The Court made the following order :- The petitioner / second accused is facing a case for the offences punishable under Sections 120(b), 420, 368, 370, 371, 374, 344 and 109 IPC and Sections 10 and 24 of Immigration Act, in S.C.No.212 of 2026, on the file of the Principal District and Sessions Court, Thanjavur, in Crime No.5 of 2024, on the file of the respondent police, seeks bail. 2. The learned Counsel for State of TN (Criminal Side) appearing for the respondent police would submit that it is a case of job racketing and that a Look-Out Circular was issued against the petitioner on 04.11.2024 and Non-Bailable Warrant has been pending against him since 20.02.2026 and upon the petitioner's arrival in India, he was arrested and remanded to judicial custody on 17.07.2026. He would further submit that if the petitioner is released on bail, there is every likelihood of his fleeing the country again. 2/6 CRL OP(MD). No.16767 of 2026 3. When the matter is taken up today, the learned counsel appearing for the petitioner filed an undertaking affidavit sworn by the petitioner, wherein, he has given undertaking that he will completely co-operate with the trial and also to appear before the trial Court on all hearings and he will not flee from India till the disposal of the trial pending before the Principal District and Sessions Court, Thanjavur. 4. The learned Counsel for State of TN (Criminal Side) appearing for the respondent police would submit that the petitioner is not having any previous cases and that necessary conditions may be imposed restraining the petitioner from going abroad till the disposal of the case. 5. Considering the above facts and circumstances and nature of the offence alleged against the petitioner and taking note of the undertaking affidavit filed by the petitioner and also the submissions made on either side, this Court is 3/6 CRL OP(MD). No.16767 of 2026 inclined to grant bail to the petitioner subject to the following conditions: 6. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the Judicial Magistrate, Thiruvaiyaru, Thanjavur District and on further conditions that: (i)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate / concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; (ii)the petitioner shall appear before the trial Court at 10.30 a.m., on all working days until further orders; (iii)the petitioner shall not leave India without the prior permission of the trial Court till the disposal of the case in S.C.No.212 of 2026 pending before the Principal District and Sessions Court, Thanjavur; (iv)the petitioner shall not tamper with 4/6 CRL OP(MD). No.16767 of 2026 evidence or witness; (v)the petitioner shall not abscond during trial; (vi)On breach of any of the aforesaid conditions, the learned Magistrate / Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate / Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
