Crl.OP(MD) No.17814 of 2026 2.Perusal of the records reveal that the petitioner is an accused in a complaint filed under Section 138 read with 142 of Negotiable Instruments Act. When the complainant was in the witness box, during the cross-examination, a suggestion was put to him as to whether he had filed a loan application. In response, he deposed that he was having a copy of the same and he was ready to produce it before the Court. Thereafter, the complainant filed a petition under Section 348 of BNSS, seeking permission to produce the said document before the Court. The said application was allowed by the trial Court. Challenging the same present application has been filed. 3.According to the learned counsel appearing for the petitioner, the complainant is trying to fill up the lacuna in his case. Such application cannot be allowed by the trial Court. 4.Heard the learned counsel appearing for the petitioner and perused the materials available on record. It is also brought to the notice of the Court that the alleged document has already been produced before the Court and marked on the side of the complainant. 5.In such view of the matter, this Court does not find any reason to interfere with the impugned order permitting the complainant to produce the 2/4 https://www.mhc.tn.gov.in/judis

With regard to the relevancy and admissibility of the document, the petitioner is always having right to raise his objection during trial. 6.With the above observation, this Criminal Original Petition stands disposed of.
