Present bail application is moved by the applicant, who is in judicial custody in connection with FIR [Case Crime No.01 of 2026] under Section 7 of the Prevention of Corruption Act (amended 2018) registered at P.S. Vigilance Establishment Centre Nainital, Haldwani. 4. Learned counsel for the applicant submits that FIR is ante time and ante date. He submits search team does not find any kind of illegal gratification either from the residential house or accommodation of the applicant. He submits that applicant was neither apprehended red handed nor any independent witness saw or hear the complainant and applicant during acceptance of alleged illegal gratification. He submits complainant and his family members are having motive to falsely implicate the applicant as applicant was investigating two cases against the complainant and another against his brother. 5. Learned State Counsel however refutes to the said submission and opposed the bail application with the contention that applicant was caught red handed although his demand is not very specific. 6. Having heard learned counsel for the parties and considering the overall facts and circumstances of the case, this Court is of the view that applicant is entitled to be released on bail. 7. Accordingly, bail application is allowed. Let the applicant-Anwar Ahmad be released on bail on his executing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned. 8.
