ORDER : The Court made the following order :- The petitioner / fifth accused, who was arrested and remanded to judicial custody on 29.05.2026 for the offences punishable under Sections 316(2) and 318(4) BNS and Section 66D of IT Act, in Crime No.63 of 2026, on the file of the respondent police, seeks bail. 2. The case of the prosecution is that on 15.02.2026, the first accused contacted the defacto complainant through Instagram by sending him a message and thereafter befriended him, that subsequently, the first accused canvassed and induced the defacto complainant to invest money in online trading for getting more profits, that believing the words of the first accused, the defacto complainant, during the period from 03.04.2026 to 12.05.2026, invested a total sum of Rs.55,62,921/- in Luno trading through 31 money transactions, that in order to make him believe, the accused transferred a sum of Rs.1,11,910/- to the account of the defacto 2/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.16948 of 2026 complainant through 4 separate money transactions and that thereafter, the accused cheated the defacto complainant. Hence, the complaint. 3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the third accused is the friend of the petitioner, due to the said relationship, the petitioner had withdrawn the amount, which was deposited in his account by the friend of the third accused and handed over the same to the third accused. 4. The learned Counsel for State of TN (Criminal Side) appearing for the respondent police would submit that there are totally five accused in this case and the petitioner is the fifth accused and that the petitioner gave a confession statement stating that in order to receive the misappropriated money, 3/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.16948 of 2026 he provided his bank account details to the third accused and on 11.05.2026, a sum of of Rs.4,63,301/- was credited to his account through 2 separate money transactions and he subsequently withdrew and handed over the same to the third accused, for which, the third accused paid him a commission. He would further submit that the bail petition filed by the accused 1 to 4 before this Court in Crl.O.P.(MD)No.16642 of 2026 came to be dismissed by this Court on 07.08.2026. 5. Considering the seriousness and gravity of the offence alleged as against the petitioner and also the fact that even as per the confession of the petitioner, he received Rs.4,63,301/- and the quantum of amount involved in this case, this Court is not inclined to grant bail to the petitioner. 6.
