ORDER : The Court made the following order :- The petitioner/A3, who was arrested and remanded to judicial custody on 10.06.2026 for the offences punishable under Sections 109, 147, 148, 294(b), 307, 342 and 364 of IPC, in S.C.No.156 of 2024, on the file of the learned Additional District and Sessions Judge (Fast Track Court), Kanyakumari District, at Nagercoil, in connection with Crime No.606 of 2021, on the file of the respondent police, seeks bail. 2.It is not in dispute that since the petitioner has not turned up for the hearing on 04.12.2024, NBW was ordered to be issued and the same was executed and the petitioner was arrested on 10.06.2026 and he is still in judicial custody. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. CRL OP(MD). No.16321 of 2026 4.The learned Counsel for State of TN (Crl. Side) appearing for the respondent Police would submit that the Session Case is pending for opening of the prosecution case. He would further submit that the petitioner is involved in one previous case under the NDPS Act for lesser quantity. Hence, he opposed to grant bail to the petitioner. 5.Considering the facts that the petitioner is in judicial custody from 10.06.2026 that the Session Case is pending for opening of the prosecution case and that the petitioner is not having any previous case for serious offence, this Court is inclined to grant bail to the petitioner subject to the following conditions. 6.Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Additional District and Sessions Judge (Fast Track Court), Kanyakumari District, at Nagercoil, and on further conditions that; (a) the sureties shall affix their photographs and 3/6 https://www.mhc.tn.gov.in/judis

No.16321 of 2026 left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; (b)the petitioner shall report before the trial Court daily at 10.30 a.m., on all working days, until further orders; (c)the petitioner shall not tamper with the evidence or witness either during investigation or trial; (d)the petitioner shall not abscond either during investigation or trial; (e)on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and; (f)if the accused / petitioner thereafter absconds, a fresh FIR can be registered under Section 229-A IPC. (K M S J)
