ORDER:
1. The present Writ Petition is filed questioning the action of Respondent No.3 in proposing to terminate the Petitioner vide Memo No.CGM(HRD)/GM(HR-II)/DGM(PEN&OS)/D.No.139/26, dated 17.03. 2026 on the ground that the Petitioner did not possess ITI qualification at the time of his appointment, as illegal and arbitrary. 2. The Petitioner claims to have pursued Industrial Training Institute (for short, ‘ITI’) (Electrician) qualification from Shivareddy ITI, Kadapa and on the basis of the said qualification, the Petitioner was engaged as Shift Operator by Andhra Pradesh Southern Power Distribution Company Limited (APSPDCL) through an outsourcing agency i.e., Respondent No.6.
While so, verification was conducted by the APSPDCL relating to the qualifications of the individuals engaged through Respondent No.6/Out-sourcing agency. Thereafter, APSPDCL issued impugned memorandum vide Memo No.CGM(HRD)/GM(HR- II)/DGM(PEN&OS) /D.No.139/26, dated 17.03.2026 stating that certain

individuals had produced fake/false ITI certificates at the time of their engagement as Shift Operator. 3. Thereafter, on the basis of the impugned memorandum, the Respondent No.6 addressed a letter to the Petitioner on 31.03.2026 calling for his explanation for producing fake ITI (Electrician) certificate during his engagement as Shift Operator, within two weeks. Questioning the same, the Writ Petition is filed. 4. Heard learned counsel for the Petitioner as well as Standing Counsel appearing for APSPDCL. 5. Firstly, there is no employee and employer relationship between the Petitioner and Respondent No.2, as the Petitioner is engaged through outsourcing agency i.e., Respondent No.6. A similar view with regard to shift operators was expressed by Division Bench of this Court in W.A.No.467 of 2023 vide its orders, dated 14.07.2023. Secondly, Respondent No. 6 called upon the Petitioner to submit an explanation with regard to the alleged fake ITI (Electrician) certificate vide letter dated 31.03.2026 and the Petitioner can give explanation rather than filing the present Writ Petition. 6
6. Therefore, this Writ Petition is devoid of merit and accordingly, it is dismissed. No order as to costs. 7. As a sequel, miscellaneous petitions, pending if any, shall stand closed. ________________________ JUSTICE NYAPATHY VIJAY
