CRL OP(MD). No.16647 of 2026 PRAYER :- For Anticipatory Bail in Crime No.308 of 2026 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioners / accused 1 and 2, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(2) and 351(3) BNS and Section 4 of Tamilnadu Prohibition of Harassment of Women Act, 1998, in Crime No.308 of 2026 on the file of the respondent police, seek anticipatory bail. 2. The case of the prosecution is that the petitioners are husband and wife and that the petitioners had attacked the defacto complainant, abused her in filthy language and also threatened her with criminal intimidation. Hence, the complaint. 3. The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. 2/6 https://www.mhc.tn.gov.in/judis

4. The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that no one was injured in the incident and that the petitioners are not having any previous cases. 5. Considering the facts that no one was injured in the incident, that the petitioners are not having any previous cases and that except the offence under Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, all other offences are bailable in nature, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. 6. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate No.IV, Madurai, on condition that the petitioners shall execute a bond for a sum of Rs.25,000/-(Rupees Twenty 3/6 https://www.mhc.tn.gov.in/judis
