ORDER : The Court made the following order :- The petitioner / accused, who was arrested and remanded to judicial custody on 09.07.2026 for the offences punishable under Section 311 BNS altered into Sections 249, 311 and 61(2) BNS, in Crime No.330 of 2026, on the file of the respondent police, seeks bail. 2. The case of the prosecution is that on 04.07.2026, the accused persons had stolen 75 sovereigns of gold ornaments and cash of Rs.9,500/- from the house of the defacto complainant. Hence, the complaint. 3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in the above case, that he is no way connected with the alleged crime and that the main allegation against the petitioner is that he gave asylum to the other accused. He would further submit that the petitioner is in judicial custody from 09.07.2026. 2/6

The learned Counsel for State of TN (Criminal Side) appearing for the respondent police would submit that except the accused 2 to 4, the other accused were secured and that the bail petitions in Crl.O.P.(MD)Nos.16851 of 2026 and 16953 of 2026 filed by the accused Prasanth and Somasundaram came to be dismissed by this Court vide orders dated 10.08.2026 and 12.08.2026. He would further submit that out of 75 sovereigns of gold jewels, 24 sovereigns of gold jewels came to be recovered, that they have taken confession from the petitioner but no stolen property was recovered from the petitioner and that the petitioner is having 3 previous cases, in which, one case for similar offence and other two cases under the NDPS Act. 5. Considering the above facts and circumstances and the nature of the charges levelled against the petitioner and also the fact that the petitioner is in judicial custody from 09.07.2026, this Court is inclined to grant bail to the petitioner subject to the following conditions: 3/6

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Sivakasi and on further conditions that: (i)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate / concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; (ii)the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of one month and thereafter, as and when required for interrogation; (iii)the petitioner shall not tamper with evidence or witness; (iv)the petitioner shall not abscond during trial; (v)On breach of any of the aforesaid conditions, the learned Magistrate / Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been 4/6

No.18227 of 2026 imposed and the petitioner is released on bail by the learned Magistrate / Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; (vi)If the accused thereafter abscond, a fresh FIR can be registered under Section 269 BNS, 2023.
