Present bail application is moved by the applicant, who is in judicial custody in connection with FIR/Case Crime No.147 of 2026 under Section 3/5/8 of Uttarakhand Protection of Cow Progeny Act and 3/11(1)(d) of the Prevention of Cruelty to Animals Act and 325, 61 of BNS at Police Station Jaspur, District Udham Singh Nagar. 4. Learned counsel for the applicant submits that applicant has falsely been implicated in the matter. He submits that applicant is not named in the FIR; his name is reflected only on the basis of the disclosure/confessional statement of the co-accused person; there is no recovery of any incriminating article, alleged animal meat, weapon, vehicle or any other material from the possession of the applicant. He submits that the offence is triable by Magistrate. 5. Learned State Counsel has vehemently not opposed the bail. 6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is of the view that applicant is entitled to be released on bail. 7. Accordingly, bail application is allowed. Let the applicant-Bhajan Singh alias Raje Singh be released on bail on his executing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned. 8.
