COURT’S OR JUDGE’S ORDERS
WPMS No. 1447 of 2026 Hon'ble Rakesh Thapliyal, J.
1. Mr. Suryakant Maithani,
learned counsel for the petitioner.
2. By the instant petition, the petitioner is praying for the following reliefs:-
“A writ order or direction in the nature of Mandamus for commanding the learned 2nd Additional District and Sessions Judge, Dehradun to decide the Appeal No. 1 of 2025, titled “Sudha Kanojia vs. Mukesh Kumar Gupta” pending in the court of Learned 2nd Additional District and Sessions Judge, Dehradun as expeditiously as possible under the facts and circumstances of the case and/or within a definite period.”
3.
Brief facts of the case are that the petitioner preferred P.A. Case No. 6 of 2022 arising out of release application under Section 21(1)(a) of the U.P. Act XIII of 1972 which was allowed by the Civil Judge (Jr. Div.) , against which Appeal No. 1 of 2025 was preferred which is pending before the 2nd Addl. District and Sessions Judge, Dehradun.
4. It is submitted by the learned counsel for the petitioner that the respondent is adopting delaying tactics to expedite the appeal, and, therefore, the Appellate Court may be directed to expedite the same.
5. The relief, as sought, appears to be innocuous.
6. In such view of the matter, the instant petition is disposed of with the direction to
the 2nd Additional District and Sessions Judge, Dehradun to expedite Appeal No. 1 of 2025 titled as Sudha Kanojia vs. Mukesh Kumar Gupta, as early as possible preferably within three months from the date of production of certified copy of this order.
