For Petitioner : Mr.J.Jayaselan For Respondents : Mr.C.Deepak Addl. Govt. Pleader ORDER Heard the arguments of Mr.J.K.Jayaselan, learned counsel for the petitioner and Mr.C.Deepak, learned Additional Government Pleader appearing for the respondents 1 to 4. 2.The writ petition is filed challenging the order passed by the third respondent cancelling the patta issued in the name of the petitioner and restoring the revenue records to their original position, as they stood at the time of preparation of the UDR Register. The said order passed by the third respondent was affirmed by the second respondent, namely, the District Revenue Officer. Aggrieved by the same, the petitioner has approached this Court. 2/7 https://www.mhc.tn.gov.in/judis W.P(MD)No.22970 of 2026 3.According to the petitioner, the fifth respondent and his mother, Chandra, were the original owners of the property. They executed a registered General Power of Attorney in the year 2007 in favour of one Savaridoss. The said power agent sold the property in favour of one Chitrambalam. The petitioner claims to have purchased the property from the said Chitrambalam under a registered sale deed dated 28.09.2010. According to the petitioner, he is the owner of the suit property. The patta issued in his name was cancelled by the third respondent, which was subsequently confirmed by the second respondent. 4.It is seen from the impugned order that the General Power of Attorney executed by the fifth respondent and his mother, Chandra, was cancelled in the year 2008, even prior to the sale of the property by the power agent in favour of Chitrambalam on 20.03.2008. Taking note of the said fact, the Revenue Divisional Officer cancelled the patta issued in the name of the petitioner and restored the revenue records to their original position, as they stood at the time of preparation of the UDR Register. 5.It is also seen that the petitioner filed a suit in O.S.No.229 of 2013 on the file of the District Munsif Court, Kulithalai, seeking an 3/7 https://www.mhc.tn.gov.in/judis W.P(MD)No.22970 of 2026 injunction against the fifth respondent and his mother, Chandra, and the same was dismissed. It is further stated that the fifth respondent and his mother, Chandra, filed a suit seeking an injunction against the Power Agent Savaridoss and the subsequent purchaser of the property from Savaridoss, namely, Chitrambalam, in O.S.No.248 of 2008 before the District Munsif Court, Kulithalai and the same was dismissed on 14.12.2021. 6.It appears that the petitioner purchased the suit property on 28.09.2010, subsequent to the institution of O.S.No.248 of 2008. In such circumstances, the petitioner is a lis pendens purchaser, and the title derived by him under the sale deed dated 28.09.2010 is subject to the result of the said suit, which was pending at the relevant point of time. 7.The learned counsel appearing for the petitioner would submit that, on the date when the petitioner purchased the property, O.S.No. 248 of 2008 was not pending, as the suit had earlier been dismissed for default. However, the fact remains that subsequently the suit was restored and was ultimately disposed of only on 14.12.2021. In such circumstances, once the suit was restored, the same is deemed to have been pending even during the period when the petitioner purchased the property. 4/7 https://www.mhc.tn.gov.in/judis W.P(MD)No.22970 of 2026 8.In the light of the above discussion, there is a serious cloud over the right and title of the petitioner, and the same cannot be resolved in the writ proceedings. The revenue authorities, taking into consideration the fact that the General Power of Attorney was cancelled by the fifth respondent even prior to the sale of the property by Savaridoss in favour of Chitrambalam, cancelled the patta and restored the revenue records to their original position. The said order was affirmed by the second respondent. In fact, in the impugned order, the second respondent relegated the petitioner as well as the fifth respondent to establish their respective rights before the competent Civil Court. In view of the said liberty granted by the second respondent, this Court finds no reason to interfere with the order passed by the second respondent. 9.Accordingly, the writ petition stands dismissed. No costs. It is needless to say that the petitioner as well as the fifth respondent are entitled to canvass all the issues before the competent Civil Court and establish their respective rights in accordance with law. Consequently, the connected miscellaneous petitions are closed. 11.08.2026 NCC : Yes/No Index : Yes/No Internet:Yes skn 5/7 https://www.mhc.tn.gov.in/judis W.P(MD)No.22970 of 2026 To 1.The District Collector, Karur District. 2.The District Revenue Officer, Karur District, Karur. 3.The Revenue Divisional Officer, Kulithalai, Karur District. 4.The Tahsildar, Kadavur Taluk, Karur District. 6/7 https://www.mhc.tn.gov.in/judis W.P(MD)No.22970 of 2026 S.SOUNTHAR, J. skn Writ Petition(MD)No.22970 of 2026 11.08.2026 7/7 https://www.mhc.tn.gov.in/judis
