Heard learned counsel for the parties.

The present writ petition has been filed by the petitioner praying for issuance of a writ of mandamus directing respondent no.2 i.e. Vice-Chancellor, Uttarakhand Aayurveda University, Dehradun to decide his representation dated 23.05.2026 for grant of permission for the re-examination in Panchakarma subject.

The said examination is scheduled to be held on
01.06.2026. The petitioner had failed in last four attempts to clear the said paper.

The case of the petitioner is that he was suffering from Anxiety Neurosis and Depression due to which he could not study properly and, therefore, failed in the paper.

It is submitted that under Regulation 6(4)(d) of the Indian Medicine Central Council (Minimum Standards of Education in Indian Medicine) Amendment Regulations, 2016, the Vice Chancellor has power to permit a student to avail one more chance to clear the paper, in case, the student was suffering from any serious personal illness or in any unavoidable circumstance.

Shri Sandeep Kothari, learned counsel appearing on behalf of the respondent-university very fairly states that the representation made by the petitioner shall be considered by the Vice-Chancellor before the examination commences. He undertakes to communicate the instant
order to him during the course of the day.

Accordingly, writ petition is disposed of with direction to respondent no.2 to consider and decide the representation of the petitioner dated 23.05.2026 before commencement of the paper of Panchakarma.

Pending application, if any, also stands disposed of.
