They are aggrieved by the development activity undertaken by the 12th respondent.
It is not in dispute that the petition mentioned survey numbers are patta lands. The 12th respondent has purchased them. However, the lands have been described as “Neer Pidi” in the revenue records. In Neer Pidi lands, activities that do not impede free flow of water alone can be permitted. 3. The learned counsel for the 12th respondent states that the 12th respondent has only installed solar panels only for the purpose of energy generation and that this will not in any way impeded the free flow of water. 4/7 https://www.mhc.tn.gov.in/judis
W.P.(MD)No.21402 of 2026 But the petitioner's counsel points out that by putting up a compound wall, he has prevented the flow of water. It is seen that the compound wall has been made of hollow block. The 12th respondent has given an undertaking before this Court. Paragraph Nos.7, 8 & 9 of the affidavit reads as follows:-
“7. The 11th and 12th respondents hereby undertake that they shall install / alter the fencing or boundary wall along the designated portions in a unique engineered manner, specifically providing structural ground-level water conduits, perforations and chain-link meshing that ensures completely free, continuous and unhindered natural flow of surface water across the terrain. 8. The 11th and 12th respondents explicitly place on record a photographic representations demonstrating a design of the porous boundary structure undertaken to be maintained by them, which features dedicated lare water-flow passages at the base. 9. The 11th and 12th respondents solemnly undertake that they shall continuously maintain the boundary wall and fencing in the structural manner depicted above throughout the duration of the project, ensuring that the natural passage of surface water is never compromised, blocked or dimnished in any manner.”
4. We direct the 12th respondent to ensure that the gap between the ground level and the slab portion of the compound wall shall have the width of 2 feet. This gap should always be kept free of any kind of obstructions. The respondents can put wire mesh. At no point of time, free flow of water shall be 5/7 https://www.mhc.tn.gov.in/judis
