ORDER : The Court made the following order :- The petitioner / first accused, who was arrested and remanded to judicial custody on 23.06.2026 for the offences punishable under Sections 318(4) and 336(3) BNS, in Crime No.184 of 2026, on the file of the respondent police, seeks bail. 2. The case of the prosecution is that the defacto complainant gave Rs.3,68,000/- to the accused in several installments between 05.02.2025 and 21.08.2025 for securing job in abroad and that the accused, without securing the job, cheated the defacto complainant. Hence, the complaint. 3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is running a company under the name of 'Senthil Andavar Abroad Job Consultancy', that the amount paid by the defacto complainant was 2/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.17028 of 2026 transferred to the third parties for his job arrangement and that the petitioner had arranged job for the defacto complainant as promised but the defacto complainant refused the same and lodged the false complaint. 4. The learned Counsel for State of TN (Criminal Side) appearing for the respondent police would submit that it is a case of job racketing and that there are totally two accused in this case and the petitioner is the first accused. He would further submit that the amount paid by the defacto complainant has not been recovered and that the petitioner is having 10 previous cases similar in nature including the present case. 5. Considering the seriousness and gravity of the offence alleged as against the petitioner and taking note of the quantum of amount involved in this case and also the fact that the petitioner is having 10 previous cases, this Court is not inclined to 3/6 https://www.mhc.tn.gov.in/judis CRL OP(MD).
