The petitioners are apprehending their arrest in connection with Balidih P.S. Case No. 05 of 2026, registered under sections 190, 191 (2), 191(2), 191(3), 126(2), 127(2), 117(2), 115(2), 109, 333, 76, 303(2) of BNS, 2023, pending in the Court of learned S.D.J.M, Bokaro. 3. Learned counsel for the petitioners submits that there is case and counter case between the parties and altercation took place due to land dispute. He further submits that for the same incident father of the petitioner no.1 has also lodged the F.I.R. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. 4. Learned counsels for the State and informant oppose the prayer and submit that allegation of assault and outraging modesty of the wife of informant are there. 5. On perusal of F.I.R. it transpires that there is direct allegation of outraging the modesty and assault against the petitioner no.1. In view of that I am not inclined to grant anticipatory bail to the petitioner no.1. Accordingly, the prayer of anticipatory bail on behalf of petitioner no.1 namely, Shamim Akhtar, is hereby rejected. 6. So far prayer of bail on behalf of petitioner no. 2 is concerned, she is lady and allegation of outraging the modesty is against petitioner no.1, I am inclined to grant anticipatory bail to the petitioner 2 namely, Zahida Khatun @ Jahida Khatun and in that view of the matter, petitioner no.2 is directed to surrender before the learned court within two weeks from today and the learned ( 2026:JHHC:10560 ) court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper. 6.
