PRAYER :- For Anticipatory Bail in Crime No.417 of 2026 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/A3, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 191(3), 296(b), 132 1/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.17096 of 2026 and 109 of B.N.S, r/w 27(2) of Arms Act in Cr.No.417 of 2026, seeks anticipatory bail. 2.The case of the prosecution is that on secret information, the police party went to the occurrence place and at that time, the petitioner along with other accused came in a Maruthi White colored Suzuki Fronx Car, abused the defacto complainant in filthy language, threatened them and attacked with aruval. Hence, the case. 3. The learned counsel for the petitioner would submit that the petitioner is innocent and not committed any offence as alleged by the prosecution. He would further submit that the second accused was granted anticipatory bail by this Court vide order, dated 31.07.2026 in Crl.O.P(MD)No.15937 of 2026 and the first accused was granted bail by this Court vide order, dated 06.08.2026 in Crl.O.P(MD)No.16486 of 2026. 4.The learned Counsel for State of Tamil Nadu (Criminal Side) would submit that investigation is in 2/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.17096 of 2026 progress and that the petitioner is having one previous case. He would further submit that the co-accused were granted bail by this Court. 5.Considering the facts and circumstances of the case, and also the fact that the co-accused (A1) was granted bail and the second accused has also obtained anticipatory bail from this Court, this Court is inclined to grant anticipatory bail to the petitioner subject to the following conditions: 6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or his appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate No.I, Kumbakonam, on condition that the petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further conditions that: [a]the petitioner and the sureties shall affix their photographs and left thumb impression in the 3/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.17096 of 2026 surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity; [b]the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of three weeks and thereafter, as and when required for interrogation; [c]the petitioner shall not tamper with the evidence or witness either during investigation or trial; [d]the petitioner shall not abscond either during investigation or trial; [e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; [f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS, 2023.
