ORDER The writ petition is filed challenging the notification issued under Section 3(1) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997. 2.Heard the arguments of Mr.R.Suriya Narayanan, learned counsel for the petitioner, Mr.C.Deepak, learned Additional Government Pleader appearing for respondents 1 to 6, and 2/6 https://www.mhc.tn.gov.in/judis
W.P(MD)No.23273 of 2026 Mr.R.J.Karthick, learned counsel appearing for the seventh respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3.The second respondent issued a notification for acquisition of the petitioner’s land situated in Survey No.3/2E1A in Nilayur Bit-II Village, Tirupparankundram Taluk, for the purpose of laying a railway siding for transportation purposes of the 7th respondent. The said notification has been challenged by the petitioner mainly on the ground that notice under Section 3(2) of the Act was not issued to him and that no enquiry was conducted under Section 3(3) of the Act. 4.Mr.C.Deepak, learned Additional Government Pleader, appearing for respondents 1 to 6, and Mr.R.J.Karthick, learned counsel appearing for the seventh respondent, would submit that notice under Section 3(2) of the Act was issued on 13.09.2023 to the person whose name was found in the revenue records. Thereafter, the notification under Section 3(1) of the Act was issued on 01.03.2024. Subsequently, an award was passed fixing the compensation on 05.08.2024 and possession of the subject land was also taken over on
21.09.2024. Therefore, it is submitted that the petitioner is not entitled to challenge the notification at this stage. 3/6 https://www.mhc.tn.gov.in/judis
W.P(MD)No.23273 of 2026 5.The learned counsel appearing for the respondents has also handed over a copy of the award dated 05.08.2024 to the learned counsel for the petitioner. 6.The learned counsel appearing for the petitioner would submit that a copy of the award had not been communicated to the petitioner till date and that the same has been furnished to him only today. Hence, he further submits that if liberty is granted to challenge the quantum of compensation awarded, in the manner known to law, the petitioner will be satisfied and further adjudication in the writ petition is not required. 7.In view of the fact that a copy of the award has been furnished to the petitioner only today, the petitioner is granted liberty to challenge the award and seek enhancement of compensation, if so advised, in accordance with law.
8.With the above observations and liberty, this writ petition is
disposed of. No costs. Consequently, the connected miscellaneous petitions are closed.
