(2) By means of this writ petition, petitioner has sought the following relief: “I- Issue a Writ, Order, or Direction in the nature of Mandamus commanding Respondent No. 4 (Executive Engineer, Nirman Shakha, Almora) to immediately relieve the Petitioner from his present post, enabling him to join his new posting at Nirman Shakha, Ranikhet, in strict compliance with the Office Memorandum No. 366 Dated 23.04.2026 (Annexure 3, page no 18).” (3) Petitioner is serving as Additional Assistant Engineer in Uttarakhand Jal Sansthan. He is presently posted at Almora. Vide order dated 23.4.2026, 9 Additional Assistant Engineer were posted as In- charge Assistant Engineer in Uttarakhand Jal Sansthan. By the said order, petitioner was given charge of Ranikhet Sub Division. Petitioner contends that he is not being relieved from Almora, therefore competent authority be asked to relieve him so that he may join at Ranikhet. (4) Learned Counsel appearing for Uttarakhand Jal Sansthan, however submits that petitioner has not physically handed over charge of the projects/works undertaken by him at Almora during his 2026:UHC:4108 tenure. He submits that if petitioner hands over charge of all the projects/works done by him at Almora, then the competent authority will have no difficulty in relieving him for joining at Ranikhet. (5) In view of the facts and circumstances of the case, writ petition is disposed of by permitting the petitioner to hand over the physical charge of all the projects/works undertaken by him during his tenure at Almora within 15 days from today. Subject to petitioner handing over the physical charge of all works/records within the stipulated time, petitioner shall be relieved for joining at Ranikhet.
