...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue Writ, or order or direction more particularly one in the Writ of Mandamus to declaring the action of the respondents in not paying the monthly salary to the petitioner from August, 2024 to till date having availed her services as principal in in MahatmaJyothiba Phule Andhra Pradesh Backward Class Welfare Residential School College (Girls) Nerawada, Panyam, Nandyal District, which is under the control of 3RD respondent inspite of written representations dt. 28.01.2025 is as illegal, arbitrary violative of Article 21 and 300-A of Constitution of India and consequently direct the respondents to pay the monthly salaries to the petitioner from August, 2024 to till date and continue to pay the same till the petitioner attain the age of superannuation i.e., 62 years without any break with all consequential benefits including regular pay allowances pursuant to the written representation dt. 28.01.2025 and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased Pleased to direct the respondents to pay the monthly salaries to the petitioner from August, 2024 to till date and continue to pay the same till the petitioner attain the age of superannuation i.e., 62 years without any break with all consequential benefits including regular pay allowances pursuant to the written representation dt.

O R D E R:
1. The present Writ Petition is filed questioning the action of Respondents in not paying the monthly salary to the Petitioner from the month of August, 2024 to till date, as illegal and arbitrary. 2. The facts in brief are as follows:-
The Petitioner is an employee working in Mahatma Jyothiba Phule Andhra Pradesh Backward Class Welfare Residential School and College (Girls), Nerawada, Panyam, Nandyal District. As the Petitioner is sought to be retired from her service on attaining the age of 60 years, she filed W.P.No.18280 of 2024 before this Court and this Court passed interim orders thereon extending the benefit of enhancement age of superannuation up-to 62 years on par with the regular employees and further directed the Respondents to continue the Petitioner in service until further orders or till attaining the age of superannuation of 62 years. Pursuant to the interim orders passed by this Court, the Petitioner continued in service and despite the fact that the Petitioner was discharging her duties; her salary was not

being paid by the Respondent-Society. Hence, the present Writ Petition is filed. 3. Today, learned counsel for the Petitioner as well as the learned Standing Counsel appearing for the Respondent-Society submits that this Court vide Common Order, dated 29.01.2026 in W.P.No.4913 of 2024 and batch allowed the said Writ Petitions holding that the Petitioners therein are entitled to be continued in service till attaining the age of 62 years. 4. In view thereof, the present Writ Petition is disposed of directing the Respondent-Authorities to pay salary to the Petitioner for the period she worked in the Respondent-Society pursuant to the interim order passed in the W.P.No.18280 of 2024. 5. No order as to costs. 6. As a sequel, miscellaneous petitions, pending if any, shall stand closed. ________________________ JUSTICE NYAPATHY VIJAY
