The present Writ Petition has been filed challenging the order dated 25.06.2026 passed by the Debt Recovery Tribunal, Madurai, in O.A. No.510 of 2019 and consequently, directing the third respondent to consider the CBI charge sheet and the other criminal case records pending before the Special CBI Court, Madurai, in C.C. No.01 of 2021, before initiating or continuing any recovery proceedings against the petitioner in the said proceedings before the Debt Recovery Tribunal, Madurai. 2/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.23918 of 2026 2. When the matter was taken up for hearing, the learned counsel for the petitioner would submit that, as against the order passed by the Debt Recovery Tribunal, Madurai, in O.A. No.510 of 2019, an effective appellate remedy is available to the petitioner under Section 30 of the Recovery of Debts and Bankruptcy Act, 1993. Hence, he would submit that liberty may be granted to the petitioner to avail the alternative remedy available under law. 3. In view of the aforesaid submission, this Writ Petition stands dismissed. However, liberty is granted to the petitioner to avail the appellate remedy available under law. No costs. Consequently, connected miscellaneous petition is closed.
