CMP(MD) No.1092 of 2026 in WA(MD) No.SR6808 of 2026 C.V.KARTHIKEYAN, J. and R.SAKTHIVEL, J. This petition has been filed seeking to condone the delay of 621 days in filing the Writ Appeal against the order dated 12.04.2024 made in W.P(MD)No. 3509 of 2021.
2. At first glance, the delay seems enormous, however, it should also be noted that the questioning the order of the learned Single Judge dated 12.04.2024, the appellant herein had filed a review application in Rev. Aplc(MD) No.138 of 2024 immediately thereafter and had persuaded the review application, which came to be finally dismissed on
04.12.2025. Challenging that order, without any delay, the appellant had filed WA(MD) No.69 of 2026. However, the appellant had necessarily to challenge the order in original and therefore had filed the present appeal and the delay had occurred owing to the pendency of the review application.
3. Notice had been directed to the respondents and the learned counsel entered appearance. It would only be appropriate that liberty is https://www.mhc.tn.gov.in/judis
granted to the appellant to canvass the issues raised in the writ petition once again.
4. Taking the above stated facts into consideration, the delay stands condoned and this petition stands allowed. The Registry is directed to number the appeal, if it is otherwise in order. When the matter is listed for admission, the name of the learned counsel, who appeared for the respondents, to be printed in the cause list.
