Pleader for RR1 to 3 Mr.M.Pozhilan for RR4 to 6 ORDER This writ petition is filed challenging the order passed by the 2nd respondent dismissing the appeal filed by the petitioner seeking cancellation of the patta issued in the name of the private respondents. 2.It is seen from the typed set of papers that the 4th respondent, who is none other than the mother of the petitioner, instituted a civil suit in O.S.No.221 of 2025 on the file of the Principal District Court, Pudukkottai, seeking declaration of her title and other consequential reliefs. Since the title dispute between the petitioner and the 4th respondent is pending in civil proceedings, the second respondent Revenue Divisional Officer rightly rejected the request of the petitioner for the time being and relegated the parties to the civil proceedings. 2/5 https://www.mhc.tn.gov.in/judis
W.P(MD)No.23609 of 2026 3.Further, if the petitioner is aggrieved by the order passed by the 2nd respondent, who is the appellate authority, he can very well file a revision before the District Revenue Officer, namely, the 1st respondent. Without availing the alternative remedy, the petitioner is not justified in filing the present writ petition. In any event, in view of the pendency of the civil suit, the 2nd respondent has rightly relegated the parties to the civil proceedings. I do not find any error in the impugned order.
4.Accordingly, the writ petition stands dismissed. It is open to the petitioner to work out his remedy before the Civil Court in the pending suit. No costs.
