No.17893 of 2026 ORDER : The Court made the following order :- The petitioner / Accused No.3, who was arrested and remanded to judicial custody on 02.08.2026 for the offences punishable under Sections 132, 296(b) and 351(3) BNS and Sections 25(1)(a) and 27(1) of Arms Act, in Crime No.782 of 2026, on the file of the respondent police, seeks bail. 2. The case of the prosecution is that on 02.08.2026, the petitioner along with other accused were found in possession of veecharuval and abused the public in filthy language and threatened them with dire consequences. Hence, the complaint. 3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in the above case and that he is no way connected with the alleged crime. He would further submit that the petitioner is in judicial custody from 02.08.2026. Hence, he prayed to grant bail to the petitioner. 2/6 CRL OP(MD). No.17893 of 2026 4. The learned Counsel for State of TN (Criminal Side) appearing for the respondent police would submit that there are totally three accused and the petitioner is arrayed as third accused and that the petitioner is having one previous case registered under Section 302 of IPC. He would further submit that no one was injured in the incident. 5. Considering the above facts and circumstances and also the facts that the petitioner is in judicial custody from 02.08.2026 and that no one was injured in the incident, this Court is inclined to grant bail to the petitioner subject to the following conditions: 6. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned District Munsif cum Judicial Magistrate, Thiruvidaimaruthur, and on further conditions that: (i)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate / concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; 3/6 CRL OP(MD). No.17893 of 2026 (ii)the petitioner shall stay at Kumbakonam and report before the Inspector of Police, Kumbakonam Town Police Station, Kumbakonam, daily at 10.30 a.m., until further orders; (iii)the petitioner shall not tamper with evidence or witness; (iv)the petitioner shall not abscond during trial; (v)On breach of any of the aforesaid conditions, the learned Magistrate / Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate / Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; (vi)If the accused thereafter abscond, a fresh FIR can be registered under Section 269 BNS, 2023.
