ORDER : The Court made the following order :- The petitioner/A6, who was arrested and remanded to judicial custody on 10.07.2026 for the offences punishable under Sections 310(2) of BNS, 2023, in Crime No.159 of 2026, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner along with other accused joined together, entered the house of the defacto complainant after sunset, at about 07.30 p.m., committed dacoity and snatched away 8 ½ sovereigns of gold jewels. Hence, the present case has been registered. 3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the co-accused were already granted bail by the Sessions Court. He is in judicial custody from 10.07.2026. Therefore, he prayed to grant bail for the petitioner. 2/6

No.17206 of 2026 4.The learned Counsel for State of Tamil Nadu (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that totally there are six accused in this case and that all of them were arrested. He further submitted that the petitioner has two previous cases. This is the second bail application and there is no change in circumstances. He further submitted that the investigation is pending in this case and the offences are grave in nature and hence, he strongly opposed to grant bail to the petitioner. 5.Considering the above facts and circumstances, nature of offence levelled against the petitioner and also the facts that the petitioner is in judicial custody from 10.07.2026; that the petitioner is having two previous cases but the same do not involve heinous or serious offence and that the co-accused were already granted bail by the Sessions Court, this Court is inclined to grant bail to the petitioner subject to the following conditions: 3/6

No.17206 of 2026 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Alangudi, and on further conditions that; (i)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; (ii)the petitioner shall report before the respondent Police daily at 10.30 a.m., until further orders; (iii)the petitioner shall not tamper with evidence or witness; (iv)the petitioner shall not abscond during trial; (v)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; 4/6
