Order 02/04/2026
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.14/2026, registered at Police Station Malarna Dungar, District Sawai Madhopur for the offence(s) under Sections 318(4), 319(2), 316(2), 336(3), 338 and 340(2) of BNS and Sections 66-C and 66-D of I.T. Act and Section 13 of RPGO.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that the accused-petitioner is in custody since 09.01.2026, charge-sheet has already been submitted, there is no substantive evidence with regard to the allegations that the petitioner has cheated any person. It is further contended that in the investigation, the Police has not recorded the statements of
[2026:RJ-JP:13883] (2 of 2) [CRLMB-1659/2026] the persons who were allegedly cheated and the charge-sheet has been submitted solely on the basis of alleged complaint instituted on cyber portal. It is argued that there are no criminal antecedents against the accused-petitioner and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.
3. The learned Public Prosecutor has vehemently opposed the bail application.
4. Heard and perused the material available on record.
5. Considering the fact that apart from the statements of the Police Officials, there is no substantive piece of evidence to indicate that the petitioner has cheated any person or persons, the charge-sheet has already been submitted, there are no criminal antecedents against the accused-petitioner, therefore, without expressing anything on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner- Deepak S/o Hansraj, in connection with FIR No.14/2026, registered at Police Station Malarna Dungar, District Sawai Madhopur, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
